Can I Keep the Tax Refund after Paying Zakah?

Question

Dear scholar, As-Salamu `alaykum. I paid Zakah to an Islamic Organization. They gave me the receipt to claim on my income tax return and get a refund from the government. Am I allowed to keep this refund that I received or should I give it to any other organization? You should keep in mind that the organization did not lose anything from my Zakah money that was given to them. They get 100%. Jazakum Allah khayran.

Answer

Wa `alaykum As-Salamu wa Rahmatullahi wa Barakatuh.

In the Name of Allah, Most Gracious, Most Merciful.

All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.

Dear brother Vali, we commend your pursuit of knowledge and your eagerness to seek what is lawful and avoid what is not. We earnestly implore Allah to bless your efforts in this honorable way.

In his response to the question you raised, Dr. Monzer Kahf, a prominent economist and counselor, states:

“You explained it by saying the Islamic organization gets the full amount you paid as Zakah and loses nothing as a result of the tax difference the government returned to you. Then you paid your Zakah. The tax refund enters your account, and you may use it or not during the year. Then at the end of the next lunar year, you will pay the Zakah on the amount you will then have (part of it is the refund that is not used for your personal and family expenses). That is it. Do not worry about the tax refund, it is your money.”
